It has come to my attention, that one of your registered members "lappner" has used and is currently using my family's name as his/her member name. It is also my understanding that the registered member "lappner" is not a "Lappner"and has no relation to our family "Lappner".

Paragraph I

(a) As a representative of the "Lappner" family I request you remove all posts, data or any other reference material which contains or closely resembles to the name, word or phrase "lappner". (b) In addition, please cease & desist any member(s) or guest user(s), that request their member name to be exactly or closely resemble to, the name, word or phrase "lappner". Any refusal to meet our request in Paragraph I, lines (a) & (b) will result in severe legal consequences.


Paragraph II

(a) For legal purposes, we ask that you comply and suBathmateit any information which could be helpful in identifying the user's identity. Information such as the user's name, home address, home telephone number, work telephone number, Internet Service Provider and/or IP address would be very much appreciative.

Not as unique as you say, a quick search online through the YAHOO search engine I was able to find many people with the last name LAPPNER. I could understand if the name in question was Penis EnlargementPSI.

For me to expect one of my members to cease and desist using a name you will need to supply me with copyright documentation stating this name as being owned exclusively to you.

Hm yeah dopefish I did wrote in some thread that Lap was my nickname, but my real surname is not Lappner. It has a similar structure as Lappner but it isn't the same. Lappner is just a nickname I developed from my surname and it sounds to me kinnda German, because I am a fan of WW2 German troops and it just sounded good to me.(for clarification I am not neo-nazi just interested in history of WW2). Well I didn't have no intention to harm anyone. Hey Legal man are you from States or from Germany.

It's a shame you had to change your name, but I really do not think you had to. If they're using 'Lappner' as some kind of corporate identity, they're the ones taking the chance of another Lappner deciding to use their name as a business name.

Just as in the case of McDonald's, I don't believe 'McDonalds' can be copyrighted, although I do believe the Golden Arches, their symbol, is. If your name is James McDonald, they cannot tell you, for example, that you cannot open a fast-food restaurant using your name. You wouldn't be able to use Golden Arches though.

Maybe there's a patent/copyright attorney here that can clarify that.

McDonalds blew the first case way out of proportion. The person that spilt the coffee only wanted money to pay for the medical bills for the skin grafts she needed on her face, hands, and crotch area because the coffee was boiling. McDonalds found it easier to make her seem stupid rather than apologize.
The other 2 are just a bunch of ignorant bastards wanting money.
